Terms of Service
1. Acceptance of Terms
Welcome to EquiDuty. By registering an account, accessing, or using the EquiDuty platform (website, web application, iOS app, Android app, and related services), you agree to be bound by these Terms of Service ("Terms").
If you do not agree with these Terms, please do not use EquiDuty. If you are accepting these Terms on behalf of an organization, you warrant that you have the authority to bind the organization to these Terms.
These Terms constitute a legally binding agreement between you (individually or as a representative of an organization) and EquiDuty ("EquiDuty", "we", "us").
The service is operated by EquiDuty AB (reg. no. 559593-8886), a limited company registered in Sweden. In these Terms, "EquiDuty", "we", "us" and "the service" mean EquiDuty AB, unless otherwise stated.
2. Service Description
EquiDuty is a Software as a Service (SaaS) platform for stable management that provides:
- Scheduling: Automated scheduling and shift distribution
- Fairness Algorithm: Weight-based system for fair work distribution
- Horse Management: Horse profiles, horse health records, and horse activity history
- Notifications: Email, SMS, Telegram, and push notifications for upcoming shifts
- Mobile Application: iOS, Android, and web application (PWA)
- Role Management: Role-based access control for stables and organizations
The service is provided "as is" with regular updates and improvements. We reserve the right to add, modify, or remove features with reasonable notice.
3. Account Registration and Responsibilities
3.1 Account Registration
To use EquiDuty, you must:
- Be at least 16 years old (or have parental consent)
- Provide accurate and complete registration information
- Maintain and update your account information
- Protect the confidentiality and security of your account
- Notify us immediately of any unauthorized access or security breach
3.2 Account Security
You are responsible for:
- All activities that occur under your account
- Maintaining secure passwords (minimum 8 characters, mixed case/numbers)
- Not sharing your login credentials with others
- Immediately notifying us of any suspected unauthorized use
3.3 Organization Accounts
If you create an organization account (stable), you are responsible for all users you invite and their actions within your organization. You must ensure invited users comply with these Terms.
4. Subscription Terms
Sections 4.2–4.5 apply to subscriptions purchased directly from EquiDuty. For subscriptions purchased inside the EquiDuty iOS or Android app, Section 4.6 applies instead.

4.2 Billing and Payment
- Billing Interval: Monthly or annual payment
- Payment Method: All payments processed securely via Stripe
- Automatic Renewal: Subscriptions renew automatically unless cancelled
- Price Changes: We will notify you at least 30 days before price changes take effect
- VAT: Prices exclude VAT
4.3 Free Trial Period
We may offer a free trial period for paid plans. You will not be charged during the trial period. If you do not cancel before the trial ends, your payment method will automatically be charged according to the selected subscription plan.
4.4 Cancellation and Refunds
- Cancellation: You can cancel your subscription anytime via account settings
- Access After Cancellation: You retain access to paid features until the end of your billing cycle
- Refund Policy: Monthly fees are non-refundable. Annual subscriptions are refundable within 14 days per Swedish Distance Selling Law
- Downgrade: You can downgrade your plan anytime. Changes take effect at the next billing cycle
4.5 Failed Payment
If a payment fails:
- We will retry charging your payment method up to 3 times
- You will receive email notifications about failed payments
- Your account may be suspended after 7 days of failed payment
- Your account may be deleted after 30 days of failed payment (with data export opportunity)
4.6 Purchases through the App Store or Google Play
Where you purchase a subscription inside the EquiDuty iOS or Android app, the following applies instead of Sections 4.2–4.5:
- Seller: Apple or Google is the seller of record. Payment is taken by the store, not by EquiDuty via Stripe, and the price shown in the store includes VAT
- Renewal and cancellation: The subscription renews automatically until cancelled. You cancel it in your App Store or Google Play account settings, not in EquiDuty. For Google Play we may additionally cancel a subscription on your behalf where these terms or a plan change require it; for the App Store we cannot, and cancellation must be made by you
- Refunds: Refunds are handled by the store under its own policy and are the store's decision, not ours. This includes any statutory right of withdrawal. Contact Apple or Google directly — we can neither grant nor refuse a refund for a store purchase
- Failed payment: If a renewal fails, the store applies its own retries and grace period before the subscription lapses. Google Play may additionally place a subscription on hold or pause it, in which case access may resume when payment succeeds. The timelines in Section 4.5 do not apply
- Price changes: Price changes for store subscriptions follow the store's own notification and consent process rather than the 30 days stated in Section 4.2
- Free trial: Trial eligibility is determined by the store and is normally available once per Apple ID or Google account for the relevant subscription group or plan
- Store account and organization: A subscription unlocks features for the organization selected at the time of purchase, while the purchase itself is tied to your personal store account. If that organization already has a subscription through another payment route, the store purchase may be refused — contact us before purchasing if you are unsure
- Apple's terms: For App Store purchases, Apple's Standard End User License Agreement and Apple Media Services Terms and Conditions also apply
5. User-Generated Content
5.1 Your Ownership
You retain all ownership rights to content you create, upload, or store on EquiDuty, including:
- Horse information and horse health records
- Photos and media
- Schedules and notes
- Organization information
5.2 License to EquiDuty
By uploading content to EquiDuty, you grant us a limited, non-exclusive, royalty-free license to:
- Store and backup your content
- Display your content to you and users you grant access to
- Process your content to provide the service (e.g., image optimization, notifications)
This license terminates when you delete the content or terminate your account.
5.3 Prohibited Content
You may not upload or share content that:
- Violates Swedish laws or intellectual property rights
- Contains malicious software or viruses
- Is offensive, harassing, or discriminatory
- Contains personal information about others without consent
- Contains sexual or violent material
5.4 Data Export
You can export all your data (horse information, schedules, records) in JSON format via account settings at any time.
6. Acceptable Use Policy
6.1 Prohibited Activities
You may not:
- Use EquiDuty for illegal purposes
- Circumvent security features or access controls
- Reverse engineer, decompile, or disassemble the service
- Use automated scripts or bots without permission
- Overload our servers or disrupt service for others
- Scrape or collect data from EquiDuty without permission
- Impersonate EquiDuty or represent yourself as EquiDuty
- Sell, rent, or lease access to EquiDuty
6.2 Consequences of Violation
If you violate these Terms, we may:
- Temporarily suspend your account
- Permanently terminate your account
- Remove prohibited content
- Notify authorities if necessary
- Take legal action to recover damages
7. Intellectual Property Rights
7.1 EquiDuty Ownership
EquiDuty, including trademarks, logo, design, code, and documentation, is owned by EquiDuty AB and protected by Swedish and international copyright, trademark, and other intellectual property laws.
7.2 Limited License to You
We grant you a limited, non-exclusive, non-transferable license to access and use EquiDuty for your internal business purposes according to these Terms.
7.3 Feedback License
If you provide us with feedback, suggestions, or ideas about EquiDuty, you grant us the right to use, modify, and incorporate such feedback without restriction or compensation to you.
8. Service Availability and Modifications
8.1 Availability
We strive to make EquiDuty available 24/7, but we do not guarantee 100% uptime. The service may be unavailable due to:
- Scheduled maintenance (we notify in advance when possible)
- Emergency or security updates
- Service provider outages (Google Cloud Platform, Stripe, etc.)
- Force majeure events beyond our control
8.2 Service Modifications
We reserve the right to:
- Add, modify, or remove features with reasonable notice
- Change pricing plans with reasonable notice for existing customers
- Update these Terms (with email notification)
- Discontinue the service entirely with reasonable notice and a data export opportunity
8.3 Service Targets
We aim for high availability and reasonable support response times, but we do not make formal SLA commitments at this stage. During incidents we publish status information once we have a clear picture of the situation.
9. Limitation of Liability
9.1 Warranty Disclaimer
EquiDuty is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of error-free, secure, or uninterrupted operation
- Warranties of data accuracy or reliability
9.2 Limitation of Liability
To the extent permitted by Swedish law, we are not liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, data, or goodwill
- Business interruption or revenue loss
- Damages arising from third-party services (Stripe, GCP, etc.)
Maximum Liability Cap: Our total liability to you shall not exceed the amount you paid us in the last 12 months.
9.3 Critical Uses
EquiDuty is not intended for use in critical life support systems, medical applications, or situations where failure could lead to death, personal injury, or severe physical or environmental damage.
10. Indemnification
You agree to defend, indemnify, and hold harmless EquiDuty AB as the operator of the service from any claims, damages, obligations, losses, liabilities, costs, or debts, and expenses (including but not limited to attorney's fees) arising from or related to:
- Your use or misuse of EquiDuty
- Your violation of these Terms
- Your violation of third-party rights
- Your content or data you upload
11. Dispute Resolution
11.1 Governing Law
These Terms shall be governed by and construed in accordance with Swedish law, without regard to its conflict of law principles.
11.2 Jurisdiction
Any disputes arising from or related to these Terms shall be resolved by Swedish courts. If you are a consumer, you have the right to bring action in the court where you reside.
11.3 Alternative Dispute Resolution
Before initiating legal proceedings, we encourage you to contact us to attempt to resolve the dispute informally. You may also turn to:

11.4 Consumer Rights
If you are a consumer in Sweden, you have rights under Swedish consumer legislation that cannot be limited by these Terms. Nothing in these Terms affects your statutory rights.
12. Termination
12.1 Termination by You
You can terminate your account anytime via account settings. If the subscription was purchased through the App Store or Google Play, it must additionally be cancelled in your store account settings (see Section 4.6) — terminating your EquiDuty account does not cancel a store subscription. Upon termination:
- Your subscription ends at the end of the current billing period
- You have 30 days to export your data
- Your data is permanently deleted after 30 days
- Refunds apply only as stated in Section 4.4, or for store purchases as stated in Section 4.6
12.2 Termination by Us
We reserve the right to suspend or terminate your account if:
- You violate these Terms
- Your use harms EquiDuty or other users
- You fail to pay fees within 30 days
- We cease offering EquiDuty (with 90 days notice)
Upon termination by us, you will be given the opportunity to export your data before permanent deletion.
12.3 Effect of Termination
Upon account termination:
- All your access to EquiDuty ceases immediately
- Your license to use the service terminates
- Provisions that by their nature should survive (liability limitations, dispute resolution) remain in effect
13. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions will continue in full force. The invalid provision shall be replaced with a valid provision that most closely fulfills the intent of the original provision.
Our failure to exercise or enforce any right or provision in these Terms shall not constitute a waiver of such right or provision.
